Article 42 Statutory tenancies by succession

Northern Ireland

(1)

Schedule 1 to the 1978 NI. 20 Rent (Northern Ireland) Order 1978 shall be amended in accordance with the following provisions of this Article.

(2)

For paragraph 2 of that Schedule there shall be substituted the following paragraph—

“

The surviving spouse (if any) of the original tenant, if residing in the dwelling-house immediately before the death of the original tenant, shall after the death be the statutory tenant if and so long as he or she occupies the dwelling-house as his or her residence”.

The following provisions of that Schedule shall be omitted—

in paragraphs 1 and 4(a) the words “or 3 ”;

The amendments made by this Article shall have effect only in relation to deaths occurring after the commencement date.
