Section 89 (duty to keep land and highways clear of litter etc) is amended as follows.

In subsection (1)—

in paragraph (b), after “special road” insert “ (other than one to which paragraph (ba)(i) applies) ”;

after paragraph (b) insert—

“(ba)

a strategic highways company as respects—

(i)

any trunk road which is a special road for which it is the highway authority, and

(ii)

any relevant highway for which it is responsible,”.
