The Secretary of State, in exercise of the powers conferred on him by section 47 of the Disability Discrimination Act 1995f1 and of all other powers enabling him in that behalf, having consulted the Disabled Persons Transport Advisory Committee and such other persons as he considered appropriate in accordance with section 47(3) of that Act, hereby makes the following Order:—

1Citation and commencement

This Order may be cited as the Rail Vehicle Accessibility (Gatwick Express Class 460 Vehicles) Exemption (Amendment) Order 2001 and shall come into force on 1st January 2002.

2Amendment

The Rail Vehicle Accessibility (Gatwick Express Class 460 Vehicles) Exemption Order 2001f1 (“the principal Order”) shall be amended in accordance with articles 3 and 4.

3Amendment

After article 4(2) of the principal Order there shall be inserted—

“(2A)

The exemption given by paragraph (2)(a) above in relation to regulation 4(2) is given on the condition that the operator provides, so far as is practicable, a person who is available on the platform to assist a blind or partially sighted person.”.

4Amendment

In article 5(1) of the principal Order for “31st December 2001” there shall be substituted “28th April 2011”.

Explanatory note

(This note is not part of the Order)

This Order amends The Rail Vehicle Accessibility (Gatwick Express Class 460 Vehicles) Exemption Order 2001 (S.I. 2001/847) by extending the expiry date for the exemption granted from the Rail Vehicle Accessibility Regulations 1998 (S.I. 1998/2456, as amended by S.I. 2000/3215) in respect of audible warning devices on passenger doors from 31st December 2001 to 28th April 2011. It makes it a condition of the exemption that the operator must, so far as is practicable, make staff available on the platform to assist blind or partially sighted persons.
