Paragraph 3 Residents of GibraltarI1

Scotland

A person who—

(a)

is—

(i)

a United Kingdom national, or

(ii)

an EU national with a right of residence in Gibraltar arising under the EU withdrawal agreement,

(b)

is ordinarily resident in Gibraltar,

(c)

is undertaking a course in Scotland,

(d)

has been ordinarily resident in the territory comprising the United Kingdom and Islands, Gibraltar, the European Economic Area and Switzerland throughout the period of 3 years immediately preceding the relevant date, and

(e)

is undertaking a course for which the relevant date is earlier than 31 July 2028.
