The Secretary of State makes the following Regulations in exercise of the powers conferred by section 41(1) of the European Union (Withdrawal Agreement) Act 2020f1.

1Citation and commencementI1

These Regulations may be cited as the Merchant Shipping (Consequential Amendments) (EU Exit) Regulations 2020 and come into force immediately before IP completion day.

2Amendment of the Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Miscellaneous Amendments) (EU Exit) Regulations 2018I1

In regulations 4(2)(b), 5(2), 9(2)(b) and 10(2) of the Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Miscellaneous Amendments) (EU Exit) Regulations 2018f1, for “exit day” substitute “IP completion day”.

3Amendment of the Merchant Shipping (Monitoring, Reporting and Verification of Carbon Dioxide Emissions) (Amendment) (EU Exit) Regulations 2018I1

In regulation 2(2) of the Merchant Shipping (Monitoring, Reporting and Verification of Carbon Dioxide Emissions) (Amendment) (EU Exit) Regulations 2018f1, for “exit day” substitute “IP completion day”.

Explanatory note

(This note is not part of the Regulations)

These Regulations make consequential provision in exercise of the power in section 41(1) of the European Union (Withdrawal Agreement) Act 2020 (c. 1) (“the 2020 Act”).

Regulations 2 to 9 amend legislation relating to merchant shipping made in order to address deficiencies arising from the withdrawal of the United Kingdom from the European Union. The provisions being amended in this instrument will come into force on IP completion day by operation of paragraph 1 of Schedule 5 to the 2020 Act. The amendments made by this instrument substitute references to “exit day” in provisions (other than in relation to commencement of those regulations) with references to “IP completion day”.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
